Advocates warn of prison sentencing chaos without legislative action

CapitolWire/State Affairs Pennsylvania: “Inaction by lawmakers before Friday’s court-set deadline to address a lawsuit seeking an end to Pennsylvania’s use of mandatory life sentences for second-degree murder convictions will lead to chaos, according to the head of a criminal justice reform group that filed the suit.
But that chaos will be preferable to the mandatory minimums that Senate Republicans tried to bake into legislation responding to the state Supreme Court, Robert Saleem Holbrook, executive director of the Abolitionist Law Center, told CapitolWire/State Affairs Tuesday.
The Abolitionist Law Center, the Center for Constitutional Rights and Amistad Law Project represented Charles Lee, a state prison inmate from Allegheny County, who successfully challenged the use of mandatory life sentences in second-degree murder cases.
The court’s March ruling impacted more than 1,100 inmates behind bars for second-degree murder convictions. Typically, these defendants were convicted of committing a felony crime during which a victim was killed. Advocates for reform say that those defendants can include conspirators who were not directly involved in the killing, such as getaway drivers.
The state House is scheduled to return to the Capitol on Thursday to advance legislation aimed at addressing the ruling though there is no sign of a compromise between the two chambers of the General Assembly.”
