Justice Stalled as Legislature Haggles 2nd Degree Murder Sentences

WENY News: “Gridlock in the court system over 2nd degree murder convictions will continue, as Pennsylvania lawmakers fail to act before a court mandated deadline.
Back in March, the Pennsylvania Supreme Court ruled that the state’s automatic life sentence rule for a 2nd degree murder conviction was unconstitutional. The ruling left unknowns for future cases, paused existing cases, and raised questions for 1,100 convicts on if they can get their sentences re-examined.
The court gave the general assembly 120 days to adjust existing laws to address the ruling’s constitutionality concerns.
Today marks 119 days since that ruling and, par for the course, Senate Republicans and House Democrats do not agree on the details and are unlikely to reconcile their differences in the next 30 hours….
The Abolitionist Law Center described the senate bill as “flawed”, raising concern with the bill still including a mandatory life sentence for certain circumstances. They also critiqued retroactive parole requirements as harsh and not acknowledging recidivism trends for those released from life sentences.”
